Terms and Conditions

By accessing or using Fitrobit's AI-powered gym management platform, including our web application, mobile apps, access control systems, and related services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access or use our services. These terms apply to gym owners, staff members, trainers, and gym members using the platform.

Permission is granted to temporarily access and use Fitrobit's services for personal or commercial gym management purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify, copy, or reverse engineer any part of the platform or AI algorithms
• Use the service for purposes outside of legitimate gym and fitness management
• Attempt to bypass access control systems or security measures
• Extract or scrape member data for unauthorized purposes
• Remove any copyright, trademark, or proprietary notations
• Transfer, resell, or sublicense the service without written authorization
• Interfere with AI features or automated systems

To use certain features of our service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis (such as monthly or annually). Billing cycles are set at the time of subscription purchase.

• Payments are non-refundable except as required by law
• You may cancel your subscription at any time
• Prices are subject to change with 30 days notice
• All fees are exclusive of applicable taxes unless otherwise stated

You are responsible for:

• Maintaining the confidentiality of your account credentials and access control devices
• All activities occurring under your account or through your access devices
• Ensuring compliance with data protection laws when handling member information
• The accuracy and legality of all data entered into the system
• Proper use of biometric access control systems in accordance with local regulations
• Securing physical access control hardware (RFID readers, fingerprint scanners)
• Obtaining necessary member consent for data collection and AI-powered features
• Ensuring staff members are properly trained on the system

You agree not to engage in any of the following prohibited activities:

• Using the service for any illegal purpose
• Attempting to gain unauthorized access to any portion of the service
• Interfering with or disrupting the service or servers
• Using the service to transmit any malicious code or viruses
• Impersonating another person or entity

The Service and its original content, features, and functionality are and will remain the exclusive property of Fitrobit and its licensors. The Service is protected by copyright, trademark, and other laws of Sri Lanka and foreign countries.

We guarantee 99.9% uptime for our cloud-based platform. However, we do not guarantee uninterrupted access and may temporarily suspend service for maintenance, security updates, or emergency repairs. We will provide advance notice when possible.

AI-powered features (attendance insights, churn prediction, personalized recommendations) are provided "as is" and continuously improve through machine learning. While we strive for accuracy, AI predictions and recommendations should be used as decision-support tools, not absolute guarantees.

In no event shall Fitrobit, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

You agree to defend, indemnify and hold harmless Fitrobit and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of the Service.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

These Terms shall be governed and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions.

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last updated" date.
