These Terms and Conditions ("Terms") constitute an enterprise-grade legal agreement between you, as an individual user and member ("Member", "User", or "you"), and Fitrobit ("Fitrobit", "we", "us", or "our"). These Terms govern your access to, installation of, and functional use of the Fitrobit V2 mobile software application ("Application").

1. Binding Agreement & Execution Threshold

By interacting with the Application, creating an account, or logging into our systems, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not accept these provisions, you must stop using the Application immediately and delete it from your mobile device. These Terms operate alongside any separate membership contract you have signed directly with your gym.

2. Grant of License & Intellectual Property Safeguards

Fitrobit grants you a limited, non-exclusive, non-transferable, revocable license to run the Application on an authorized mobile device for personal fitness management. The Application uses a dynamic layout engine that displays your gym's branding (logo, colors, images) after login. You acknowledge that this visual change does not give you or your gym any ownership over the software. All source code, database schemas, API systems, UX workflows, designs, patents, and trademarks remain the exclusive property of Fitrobit.

3. User Account Security Responsibility & MFA Disclaimer

You are entirely responsible for keeping your login credentials confidential and secure. While Fitrobit hashes passwords to prevent direct database leaks, this version of the Application does not support Multi-Factor Authentication (MFA). Account password resets are managed through automated validation links sent to your registered email address. You accept full responsibility for any unauthorized activity on your account that results from a weak password or a compromised email inbox.

4. Data Ownership Boundaries & Unrestricted Instructor Access

You explicitly agree that Fitrobit serves as an infrastructure host and does not own the data you input. All data—including body metrics, progress photos, nutrition choices, and goals—belongs legally to your gym (the Gym Client). Because the Application is built to help trainers work with members, you grant your gym and Fitrobit the right to share all your logged metrics and uploaded photos directly with your assigned trainers and gym staff without needing separate approvals for each item.

5. Acceptable Content Standards & Media Upload Licenses

When you upload content to the app, such as progress photos or personal tracking notes, you confirm that you have the legal right to do so and that it does not violate anyone else's privacy or intellectual property rights. You are strictly prohibited from uploading content that is obscene, inappropriate, illegal, or files that contain software viruses, malware, or harmful code designed to disrupt the Application's operations.

6. Professional Medical & Health Liability Disclaimer

FITROBIT V2 IS ONLY A DATA TRACKING, SYSTEM MANAGEMENT, AND COMMUNICATION TOOL. FITROBIT DOES NOT PROVIDE MEDICAL ADVICE, HEALTHCARE PLANS, OR CERTIFIED CLINICAL DIAGNOSES. Any workout schedules, macro splits, calorie targets, or health advice sent to your app profile are created entirely by the trainers and staff employed by your gym. Fitrobit is not responsible for injuries, health issues, medical emergencies, or physical complications that may happen if you follow these trainer-assigned plans. Always talk to a doctor before starting a new exercise or nutrition routine.

7. Limitations of Liability & Cloud Platform Performance

To the maximum extent permitted by law, Fitrobit, its directors, and its cloud provider partners shall not be liable for any indirect, accidental, or consequential damages. Because our software runs on cloud services via Amazon Web Services (AWS) and MongoDB, we cannot promise 100% uninterrupted uptime or absolute immunity to cyberattacks. Fitrobit is not responsible for data losses, account access issues caused by weak user passwords, or any financial or personal disputes that happen between you and your gym.
